‘NO OBJECTION’ SA ICC! Duterte, Di Pipigilan Kung Susuko

Hindi magiging balakid ang pamahalaan sakaling mapatunayang guilty si dating pangulong Rodrigo Duterte ng International Criminal Court (ICC) sa paratang na “crimes against humanity” at sumuko ito.

Sa isang pahayag, sinabi ni Executive Secretary Lucas Bersamin na hindi pipigilan ng gobyerno ang nais ng dating pangulo kung nanaisin nitong magpasakop sa hurisdiksyon ng ICC. 

“If the former president desires to surrender himself to the jurisdiction of the ICC, the government will neither object to it nor move to block the fulfillment of his desire,” aniya.

Inihayag ni Duterte sa pagdinig ng House quad committee kamakailan na handa siyang mabulok sa kulungan kung mapatunayang guilty siya. 

Sinabi rin ni Bersamin na ang pamahalaan ay makikipagtulungan sa ICC sakaling maglabas ito ng “red notice” sa pamamagitan ng Interpol. Ang red notice ay isang kahilingan sa mga law enforcement agency sa buong mundo para matunton at maaresto ang isang indibidwal para sa extradition o kaugnay na legal na aksyon.

“But if the ICC refers the process to the Interpol, which may then transmit a red notice to the Philippine authorities, the government will feel obliged to consider the red notice as a request to be honored, in which case the domestic law enforcement agencies shall be bound to accord full cooperation to the Interpol pursuant to established protocols,” ani Bersamin. 

Sa kasalukuyan, patuloy ang ICC sa pagkalap ng ebidensya sa mga umano’y krimen na naganap sa ilalim ng drug war ng dating pangulo. Ayon sa datos ng pamahalaan, mahigit 6,200 drug suspects ang nasawi sa anti-narcotics operations mula Hunyo 2016 hanggang Nobyembre 2021. 

Samantala, nananatiling matatag si Pangulong Ferdinand Marcos Jr. sa paninindigang walang hurisdiksyon ang ICC sa Pilipinas. Ayon sa kanya, may kakayahan ang bansa na magsagawa ng sariling imbestigasyon at hindi na kailangan ng pakikialam ng international tribunal. Sa katunayan, tuluyang humiwalay ang Pilipinas sa ICC noong Marso 2019, isang taon matapos ihain ang formal withdrawal sa United Nations mula sa Rome Statute.
