Isinusulong ni Davao City First District Representative Paolo Duterte ang agarang pag-apruba sa kanyang panukalang batas na naglalayong lumikha ng tatlo pang Municipal Trial Court in Cities (MTCCs) siyudad upang tiyakin ang mabilis na pagbibigay ng hustisya para sa bawat kasong isinampa.

Sa isang pahayag ngayong Martes, sinabi nya na ang House Bill No. 3272, na naglalayong lumikha ng tatlong karagdagang sangay ng MTCC sa 11th Judicial Region na ilalagay sa Davao City, ay inaprubahan na sa committee level ng mababang kapulungan.

Sinabi ni Duterte na ilang mga pagtatangka ang ginawa upang i-declog ang mga docket ng korte, ang pinakamahalaga ay ang Republic Act No. 11576 o ang Judiciary Reorganization Act of 2021, na nagpalawak sa hurisdiksyon ng mga first-level court.

“The said piece of legislation will eventually declog second-level courts, particularly the Regional Trial Courts. In response to this judicial innovation, there is an immediate need to increase the number of first-level courts, namely: Metropolitan Trial Court (MeTC), MTCC, Municipal Trial Courts (MTC), and the Municipal Circuit Trial Courts (MCTC),” paliwanag niya.

Ayon sa mambabatas, aa Davao City, pito lang ang existing MTCC branches. Ngunit sa mga sangay na ito, apat lang ang regular na nira-raffle para sa mga kaso dahil ang isang sangay ay gumaganap bilang isang environmental court, ang isa pa ay may isang namumunong hukom na gumaganap bilang Executive Judge na may karagdagang mga tungkulin at obligasyong pang-administratibo, at isang sangay ay pansamantalang “held in abeyance” dahil umabot na sa 1,500 ang caseload.

Sa kalagitnaan ng 2022, humigit-kumulang 6,693 kaso ang itinalaga sa mga kasalukuyang sangay, hindi kasama ang dalawa na naka-lockdown, dagdag niya.

“The number of cases is expected to increase considering the expansion in the threshold amount of small cases to P1,000,000.00. Hence, this bill seeks to create three additional branches of MTCC for Davao City in order to decrease the pending cases before the city’s judicial bodies and to ensure the swift administration of justice for every case filed. Thus, the immediate approval of this bill is earnestly sought,” giit ni Duterte.

Kapag naaprubahan ng Senado at House of Representatives, ang  Chief Justice ng Korte Suprema, sa pakikipag-ugnayan sa Secretary of the Department of Justice, ay agad na isasama sa programa ng Korte ang agarang pagpapatupad ng batas.

“The Constitution grants that all persons shall have the right to a speedy disposition of their cases before all judicial, quasi-judicial, or administrative bodies,” ipinunto ni Duterte.
