Sandigan Bayan sought Virgilio Ocaya for violating the Anti-Graft and Corrupt Practices Act 19 years ago.
Okaya, the lawyer of the Presidential Commission on Good Government (PCGG), received double compensation amounting to PHP 129, 600 from January to June 2003. Ocaya is also serving as Deputy Administrator for Administration and Legal Affairs of the Metropolitan Waterworks and Sewerage System Regulatory Office (MWSS-RO) from September 2002 up to June 2002.
In total, the PCCG lawyer received PHP 278, 388 per anum working in the two government posts from 2002 to 2003 and has 24, 000 monthly remuneration, which is prohibited under the law.
According to the decision of Sandigan Bayan on March 18, “The Constitution and law prohibit dual employment and double compensation. Hence, in view of such prohibition, the compensation the accused received from the PCGG was unauthorized or without justification.”
However, the lawyer reiterated that holding a post in MWSS-RO is not considered a public office, citing that he has never received public funds for his employment.
Sandigan Bayan noted in the decision that Ocaya’s income return when he held as the Deputy Administrator for Administration and Legal Affairs in 2003, and must not accept the other post in the government.
