Isinulong ni Davao City 1st District Rep. Paolo Duterte at Benguet Rep. Eric Yap ang pagpasa ng batas kung saan hindi kasama ang mga nahatulan ng karumal dumal na krimen sa Good Conduct Time Allowance (GCTA).
Sa isang pahayag, sinabi nila na ang panukala sa ilalim ng House Bill (HB) 4649 ang lulutas sa pagkukulang ng Republic Act (RA) 10592 o ang GCTA law na naisabatas noong 2013.
Sa ilalim ng GTCA law, itinaas ang credits ng mga persons deprived of liberty (PDLs) para sa good conduct para mabawasan ang kanilang sentensya sa bilangguan.
Noong 2019, nagkaroon ng kontrobersiya ang batas pagkatapos lumaya ang 2,000 na mga convict na nahatulan ng karumal dumal na krimen dahil sa re-computation ng kanilang GCTA credits.
“The spirit of RA 10592, which revised the computation of the good conduct time allowance for persons deprived of liberty, is justice with mercy. However, it should only benefit those who deserve it—those who have been reformed and are ready to be reintegrated into the society without posing a threat,” pahayag ni Duterte sa pagsulong ng HB 4649.
Upang masigurado na patas ang pagbigay ng GCTA credits, isinaad ni Duterte at Yap sa HB 4649 na may mandato ang Secretary of Justice na gumawa ng “objective and quantitative criterion for the evaluation and credit of the Good Conduct Time Allowance (GCTA) to be used by the Director of the Bureau of Corrections, the Chief of the Bureau of Jail Management and Penology (BJMP), and/or the Warden of the provincial, district, or city jail in granting good conduct.”
