Nagbaba ng desisyon sa pangalawang pagkakataon ang Timor-Leste Court of Appeal at pumayag muli sa extradition request ng Pilipinas para kay dating Negros Oriental 3rd District Representative Arnolfo “Arnie” Teves Jr.

Sa kanilang 42-page ruling, nilinaw ng korte na maayos at functional ang justice system ng Pilipinas, laban sa alegasyon ni Teves na prejudged na ang kaso niya.

“The allegation of the facts imputed to the extradite (Teves) … did not constitute a prior judgement of these facts, nor an attempt to demonstrate to the Timorese State that the extraditee is guilty and will be sentenced, which would be pointless since the trial has not even taken place in the Philippines,” sabi ng Timor-Leste court sa decision nito.

Punto ng Timorese court: Hindi raw binigyan ng hatol si Teves sa extradition request. Ang layunin ng dokumento ay sumunod sa formal requirements, at di raw nito sinasakal ang karapatan ng dating mambabatas sa depensa.

Binigyang-diin din na maraming extradition cases na ang naibigay ng Pilipinas tulad ng kaso ni Kerwin Espinosa mula United Arab Emirates noong 2016 at ni Nur Misuari mula Malaysia noong 2002.

Sa pag-ayon ng Timor-Leste sa hiling ng Pilipinas, maaaring tuluyan nang maibalik sa bansa si Teves para harapin ang mga kasong multiple murder, kabilang ang umano’y pagpatay kay Negros Oriental Governor Roel Degamo at iba pang biktima.

“Pangalawang pagkakataon na ho ito, at parehas pa rin ang desisyon nila kaya hindi natin, we do not expect na mag-iiba pa po yung decision ng Court of Appeal ng (of) Timor-Leste,” ani Justice Assistant Secretary Mico Clavano.
