Tapusin na yarn! – ito ang panawagan ni Senador Robin Padilla hinggil sa isinusulong na cooperation talks sa pagitan ng Pilipinas at International Criminal Court (ICC) upang maimbestigahan ang “drug war” ng administrasyong Duterte.

Isa sa mga mambabatas na pinakabagong nagpahayag ng pagsuporta para sa ICC probe ay si 1-RIDER Party-list Representative Rodge L. Gutierrez, na binigyang-diin ang kahalagahan ng pagpapanumbalik ng reputasyon ng bansa at paggalang sa rule of law.

“Such an issue should have already ended when the Philippines withdrew as a member of the ICC during the administration of former President Rodrigo Roa Duterte,” pahayag niya. “I wish to put a definite end to it now because it will bring only confusion to our people.” 

Sa halip, hinimok ng mambabatas ang mga Pilipino na magkaisa sa likod ng desisyon ng gobyerno na umatras sa ICC at tanggihan ang pagpasok nito sa bansa. Inilabas ni Padilla ang kanyang pahayag habang ang mga kapwa mambabatas sa House of Representatives ay nasampa ng mga resolusyon na humihimok sa gobyerno na makipagtulungan sa imbestigasyon ng ICC.

Isa sa mga pinakabagong mambabatas na nagpahayag ng kanyang suporta para sa ICC probe ay si 1-RIDER Party-list Rep, Rodge L. Gutierrez, na binigyang-diin ang kahalagahan ng pagpapanumbalik ng reputasyon ng bansa at paggalang sa rule of law.

“In July of this year, the ICC through its Appeals Chamber denied the Philippine Government’s appeal and upheld authorization of the ICC Prosecutor to resume its investigation into the situation of the Philippine drug war. Subsequent to the denial, the Philippine Government expressed its refusal to cooperate with the ICC, citing issues of jurisdiction in light of its withdrawal of membership in the institution,” paliwanag niya.

Binigyang-diin ni Gutierrez na ang pagtanggi na makipagtulungan ay mali at maaaring makapinsala sa katayuan ng bansa sa global stage. Nagpahayag siya ng pagkabahala na ang ganitong posisyon ay maaaring makasira sa reputasyon ng bansa.

“This resolution here today is to urge the executive, through its relevant government departments and agencies, to extend its full cooperation with the prosecutor of the ICC. That is, to give due course to the investigation and restore our nation’s reputation as one respecting the rule of law and human rights,” giit niya.

Nilinaw ng mambabatas na ang resolusyon ay hindi kawalan ng kumpiyansa sa kakayahan ng Department of Justice na usigin ang mga kaukulang krimen. Sa halip, idiniin niya na ang pakikipagtulungan sa ICC ay makakatulong sa domestic justice system at magpapahusay sa dispensation of justice.

“We are simply of the opinion that the complementary nature of the ICC, and our cooperation with them, can only serve to bolster our own dispensation of justice,” aniya.

“We believe that ignoring the proceedings and repeatedly falling back to the argument of jurisdiction does not promote our interests, especially given the fact that no less than the Supreme Court in a 2021 decision ruled that the ICC maintains jurisdiction on the matter,” dagdag ni Gutierrez.
