Ibinasura ng Sandiganbayan ang mga kasong graft at falsification laban kina dating Bise Presidente Jejomar Binay, anak nitong si Junjun Binay, at 13 iba pang opisyal na may kaugnayan sa P1.4 bilyong kontrata para sa pagpapatayo ng 10-palapag na Makati Science High School (MSHS) building.

Sa 86-pahinang resolusyon na inilabas noong Disyembre 13, 2024, kinatigan ng korte ang demurrer to evidence ng mga akusado, dahilan upang tuluyang ibasura ang mga kaso.

Ayon sa tribunal, “Another factor that bolsters good faith on the part of the accused… is the absence of audit memoranda or notices of disallowances issued by (the) Commission on Audit [COA]. Throughout the construction of six phases of MSHS buildings …not one adverse finding from COA was issued.”

Nagsimula ang kaso noong 2015 nang maghain ng reklamo ang Office of the Ombudsman ukol sa umano’y iregularidad sa konstruksyon ng MSHS at sa procurement ng architectural at engineering services na nagkakahalaga ng P16.45 milyon. Inakusahan ang mga Binay at iba pang opisyal ng pakikipagsabwatan sa Infiniti Architectural Works at Hilmarc Construction Corp. para sa umano’y “simulated bidding.”

Kasama sa mga naabsuwelto sina dating City Administrator at Bids and Awards Committee (BAC) Chairperson Marjorie de Veyra, City Legal Officer Pio Dasal, Budget Officer Lorenza Amores, mga accountant na sina Leonila D.G. Querijero at Cecilio Lim III, City Treasurer Nelia Barlis, BAC Secretariat Member Norman Flores, at BAC Members Giovanni Condes, Rodel Nayve, Eleno Mendoza, Gerardo San Gabriel, Manolito Uyaco, at Ralph Liberato.
